It is mutually agreed that the
following terms set out in this booking form is the total agreement
made between the parties, and that no variation or modification
of this contract shall be effective unless accepted by both sixone
media and the client, in writing.
1. BOOKING DEPOSIT: A
non-refundable deposit of 30% of the job is required at the time
of booking, together with a signed contract. Dates are reserved
only when this deposit is paid.
2. BALANCE PAYMENT: The balance payment
is to be made not later than 5 days on the due to complete date.
Payment for additional dvd, photographs, prints & pages is
made after the event at the time of ordering.

4. CANCELLATION: If sixoone media
have to cancel this contract for reasons beyond their control,
(death, injury, sickness etc.), their liability shall be limited
to a full refund of all monies paid. In the event of the client
cancelling a booking, sixoone mediareserves the right to charge
a cancellation fee in accordance with the following scale.
• If cancelled within 1 week of the event– 75%
• If cancelled within 2 days of the event– 100%
In the event of sixoone media taking another booking for your
cancelled or postponed date a full unconditional refund of your
deposit and monies paid shall be made.
5. CREATIVE LICENCE: sixoone
media shall be granted creative and artistic licence in relation
to the choice of locations and poses used. sixoone media’s
judgement on photographic style and the number of photographs
taken shall be deemed correct. sixoone media cannot be held responsible
for lack of coverage caused by members of the party not being
ready on time, nor by the restrictions placed on the photographer
by officials of the venue. Due to changes of the weather and the
availability and willingness of subjects sixoone media will do
its best to honour requested photographs but do not undertake
to guarantee any specific picture nor incorporate any specific
background, location or group arrangement.
6. COLOUR MATCHING: The dyes used
for clothing, particularly man made fibres do not always photograph/
film in the manner which they appear to the eye. When the photographs/
dvd are made ready such materials may appear incorrect, however,
sixoone media will endeavour to achieve the closest possible colour
match within the limitations of the materials and process used.
7. COPYRIGHT: The 1998 Copyright,
Designs, and Patents Act assigns copyright to sixoone media. You
may not copy the photographs/ dvd taken under this contract, or
allow copies to be made photographically, electronically, or by
any other means.
8. FORCE MAJEURE: In the unlikely
event of total equipment failure, injury or sickness beyond sixoone
media’s control, their liability shall be limited to a full
refund
9. DISPLAY: The client hereby allows
the photographer to display any images included in this contract
in their studios, portfolios, literature, exhibitions, website
and advertising. No use of the images will be made by the photographer
for other commercial reason except with the written permission
of the client.
10. EXCLUSIVITY: sixoone media shall
be the sole professional videographer at the venues specified
unless adviced otherwise before hand.
11. DELIVERY OF DVD: The client will
pick up the finished album from the photographer. If this is not
possible, sixoone media will send the album by secure post, for
which the client will be charged a flat fee of £25.00..
12. PRIVACY: sixoone media will store
your name and details on a private internal database. These details
will not be made available to companies or individuals outside
of sixoone media.
All printing orders must be prepaid, in FULL.
24hour service(Graphic Design ONLY): To qualify for 48 hour rush
service. All material to be used must be provided, (images,
artwork, digital files, and/or textual content) and approved within
24 hours.
Rush orders are subject to a £50.00 24hr service charge.
